Legal advice?
I am a high school student who is constantly in a merchant based business.... I sell drink, candy, all kinds of crap at school and many times ive been threated that the school can press some kind of charge on me, get me introuble with police, and take all my money. is that true or is it bullcrap. the school legally isnt allowed to sell candy to students in the state of florida but they do anyways. Can i get in trouble at school?

- Look up 'Pan handling' in your state. I don't thinks it so much illegal as against school policy. You're there to learn the three R's, not get rich slowly...so they can probably kick you out of school if there is a rule about it and you don't cease and desist.
- I am pretty sure you can't legally sell stuff like that in a school! You probably have to have some kind of a business license! I used to work in a school and they sold snacks but the reason they could was because it is nonprofit and the money would go back into the schools programs! Also most state have laws about what kind of foods can be sold in a public school system!!! Because of nutritional guide lines setup by the government that is why most schools do not sell donuts and ho Ho's things like that anymore!!! They are forced not to sell that kind of stuff because they can lose federal funding if they do not follow those guidelines. So have fun until they bust you but if it is like the school I worked in you would almost have to murder someone to get charged with anything!!!
- It's not really a legal issue, because federal, state and local governments give a LOT of leeway to schools as far as disciplining students. If you took it to court, you would lose, because the school has an inherent duty to make you learn and as such, an inherant right to tell you not to sell on school property. It could fall under local panhandling laws, or soliciting laws (I'll bet there's a "no soliciting" sign on school property, and if there isn't, I'm sure it's in the rule books somewhere). So, the short answer is, they can do what they like.
