legal advice?

ok well i went for my pap smear and i got the results back saying that everything was fine this was back in april then a week ago i get a letter stating that they sent me the wrong test results is there anything that i can do about it?

  4. This same thing happened to me with Kaiser except it was way worse than yours and my only legal recourse was to go to mediation. How do they give someone's life back to them that they stole basically for 9 months - they don't. Good Luck!
  5. You haven't mentioned if the letter stated you had cancerous cells or anything. If it still came back normal, then you have nothing to fear and no basis for a law suit, there would be no harm.
  6. i'd think that you would have to be able to prove that having gotten the results delayed you treatment / caused you harm ? i would re test to be absolutely sure all is well. you have much better odds with anything that you catch early.

There are several factors that would need to be explored that are not mentioned in your question...such as ... did the new report findings have time sensitive information i.e. it could have been treated if the results were known before a particular date -- and now cannot be treated. It seems that your right to privacy may have been violated; and you feel awkward about it. That is justified...medical information IS confidential; however, unless there is emotional distress or other associated illness that the error has brought about, it may not be tortable. Speak with the attorney. Have you sought emotional treatment to help you to cope with your feelings of having your privacy violated? Unless there are some costs involved, the elements will not have been met. No offense intended, counseling centers are wonderful places that help us to learn to express our feelings in ways that are safe for us and others. Did you feel that it was an intentional error? Do you have any basis for that type of feeling? Is it a feeling or a fact? Take care ... don't throw anything that I would not throw.
  8. you need a doctor, not a lawyer. If you ask a lawyer, they will tell you that unless you have had some tangible quantifiable damage resulting from getting the wrong results, to get over it and devote your energies to your health.
  9. Anything you can do about it? Like what? You actually have to have lost something to sue someone for it. A clerical error is not negligence or fraud or a tort, and you didn't lose anything. Just be happy you're ok.
