Legal advice relating to a phone contract?

A friend of mine asked me for some advice. She came to Britain as an international exchange student from China and got a contract with Vodafone, pay monthly, for twelve months, december 2005 til december 2006. Since she returned to China about four months ago she has recieved letters from the company. It is hard to get the exact details from her owing to language difficulties, but she says they say she has missed payment and owes £290, with an additional £80 for legal costs (whatever that means). She just wants to know how to resolve the problem. She says the contract began on 6th december 2005 and they charged her for an extra month, between dec 6. 2006 and jan. 6. 2007 She says the contract began on 6th december 2005 and they charged her for an extra month, between dec 6. 2006 and jan. 6. 2007 She says the contract began on 6th december 2005 and they charged her for an extra month, between dec 6. 2006 and jan. 6. 2007 She says the contract began on 6th december 2005 and they charged her for an extra month, between dec 6. 2006 and jan. 6. 2007 She says the contract began on 6th december 2005 and they charged her for an extra month, between dec 6. 2006 and jan. 6. 2007

  1. sometimes companies will do that, even though your contract is up,they'll keeping charging you.you have to call them when its up and tell them if your going to continue with their services or end them since the contracts up,so they'll know to stop billing you...and with the "legal fee",that could be because of the alledged missed payment or they might be charging her for just a late payment...
  2. like the first answer they will keep charging you till you tell them you dont want there service anymore, do it now before you get in to deep with charges on charges your phone should stay active to use on pay as you go with them they may send you a sim to do this if asked when you have payed out standing bill and ended your contract with them
  3. its not a 12 months contract, you dont ahve fixed term contracts. if people actually bothered to read terms and conditions before they signed, they would see its actually a minimum commitment term, no where does it say the contract finished after 12 months, but it does say to cancel you need to send 1 months notice in writing. the only way for your friend to resolve it is to either pay the costs, or go to court. sorry if it sounds abit harsh, but its a lesson people need to learn, read your terms and conditions before you agree to anything
