Challenging power of attorney? My uncle was made power of attorney by my grandfather before he died, and my grandmothers name was taken off all of her checking accounts because she has Alzheimer's, and my grandfather didn't want her on the accounts for fear that she would give all of the money away because she's not "of sound mind" and we wouldn't be able to pay for her care, if she became worse. Well she had to go to the hospital for surgery 6 months ago, and the day she went in my uncle began to drain my grandmothers account (that was NOT even supposed to be touched until she died! It was intended by my grandfather to pay for my grandmothers care, and what remained was to be split 50/50 between my mother and my uncle.) Long story short there was a sufficient amount of money in the account, and when my uncle was finished there was not even enough to buy a new car left! And, my mom took out some of what was left, because she has to pay her attorney more money (for her divorce from my father) and my uncle now, is withholding her bi-monthly check, (he basically runs a business that my grandfather started and writes all the checks for it, and pays himself handsomely I might add.) Saying that she "already got her money" when it is to pay her attorney with! And now the account is completely drained, and my mom barely even get hardly any of her inheritance. She talked to her attorney about suing my uncle and he said that it is hard to challenge a power of attorney in court. And, thanks to my uncle spending my grandmothers life savings, we can't afford to keep her in the nursing home, but only for a few more months, and she is going to have to live with my mom and I, who are not equipped to take care of her. Obviously, we can't afford an attorney since he spent all of the money, but is there some way that my mom and I can legally make him pay us back every dime he squandered on himself? Now, my grandmother now knows all about what her son has been up to (while my mom and I sacrificed our time taking care of her, at the nursing home and visiting her several times a week, an hour away while she was in the hospital I might add!) and my grandmother does not want my uncle to get any of the profits when her house is sold, or when the business, is sold. Is there a way we can keep my uncle from collecting anymore money he doesn't deserve? And, to legally make him pay back all of the money he flat-out stole from us?

Due to this my partner is now caring (taking shopping, collect pension, attending hospital appointments) for his nan. Then last week his nan's health took a turn of a worse and she was found wondering the streets - confused and dazed. She was taken to hospital were she told nurses, doctors and police that her house was robbed by some youths and they took her savings, bank book and pension book, but because the story didn't make much sense the police haven't taken the claims serious. We can not locate her bank book and pension book anywhere - as for the savings, its proving it was there.. She is still in hospital as she is slowing going senile and is adament all this crazy stuff is happening - when i saw crazy i mean she thinks her sisters died, that the police have chopped of my partners ears because he has visited her etc... She is not waiting to see a Specialist to see if the can 'classify' what is wrong with her!! So back to my question - due to all of this would be partner be able to claim Power of Attorney, as at the moment we don't know if anyone does have her details and are taking money from her account - we have tried getting the police involved to check the accounts by they aren't interested. My partner isn't looking to touch any of her accounts, but just requires the rights to monitor them and make sure nothing untowards is happening.. Eviction, Power of Attorney, Prison... in FL? My buddy rented out some office space from a guy here in town. Power of Attorney needed? Ok, I'm really confused here. I'm not one to be very knowledgeable regarding a Power of Attorney or legal matters, so I'm hoping some of you can help me out. But if she is, it's no excuse. My question is though, can my mom and the other siblings contest the power of attorney? Would it be worth it? I think it would benefit all around if my grandmother could be taken care of in a facility equipped to deal with people with this disease. My mom and her other siblings can't be there 24/7 and there's no way for her to be moved in with anyone in the family, none of us are trained in this sort of thing anyway, and we're all worried she'll do the cliched turning on the burner and dying in a fire. Any one have experience in this? Should they contest my aunt's standing as power of attorney? A little over a year ago I signed a several paged power of attorney form for myself and my son, giving many rights to my parents due to a situation I was experiencing at the time. My mother is having issues with her mother, my grandma. my grandma has schizophrenia and paranoia and is on medication but it alters her sense of logic and it only makes her problems more subtle, not really gone. she also has kidney failure and is soon going to be put on dialysis. she cant drive so my mother takes her everywhere she needs to go. my grandma and my mother are both in a state of financial crisis, but recently my great grandma told my mom about a program for widows of veterans (which she and my grandma are, my great grandma is on this program). if someone has the power of attorney over the widow it allows them 1800 dollars a month to take care of them. not only would that help us both tremendously financially, but if she lived with us it would save gas for when she needs to go for dialysis 2 to 3 times a week, help with groceries, help us watch her and help everyone all around. but my grandma, stubborn and illogical as she is, refuses to do it. shed rather be miserable and live in her one bedroom elderly complex apartment than come to live with my mother me and my brothers in our 4 bedroom house. (we have an extra bedroom she could have, in her own section of the house). her medication, like i said, alters her logic. in the state of alabama what would be the chances of gaining power of attorney in court?

Trouble with Power of Attorney? My fiance's dad got a power of attorney so that we could sell his truck. He's over in Afghanistan and we got the POA about a month after he left, so we only have a fax copy of it. Can power of attorney be reversed even though early signs of alzheimer are present? My sister took power of attorney over our parents. My mother has always handled most of the finances. At the time my mother was over medicated which caused her to have severe symptoms of alzheimers and so my sister put her in a nursing home and became power of attorney. Once her medication was corrected she became very coherent about 95% of the time. My father has moved in with me and my family. My sister continues to have power of attorney and we believe that she is using our parents money for her own benefit. Is there any way to determine what financial transactions have been made? Is it possible to change power of attorney even though out parents may have slight signs of alzheimers? I've added these comments after seeing some of the answers. This originally started in Arkansas and we then moved them up to Illinois were we live. Also, my parents get a couple thousand a month from SS. My sister only gives me about $200/month to care for my father. Is she free to use the rest for her own personal use or should it be directed into my parents savings account? We have also recently learned that my parents will has been changed so that eveything will pass to my sister if they die. After talking with both of my parents they have told me that they wanted everything to be split between the two of us. Here's my situation, I'm 24 years old, my father is 47 and completely disabled. He is on social security and has medicare and medicaid. He has diabetes, end stage renal failure, hypertension and is legally blind. He's been in and our of the hospital for years. I went to the pharmacy yesterday to obtain copies of his prescription numbers so it would be easy for me to call them in when he comes home from a nursing facility on thursday but becasue of the HIPAA laws they said no. How to proove Power of Attorney? When I was 17, my father had a massive heart attack and passed away. Because I was only 17 I was not permitted to become the Power of Attorney or Administrator of his estate. (My mother and father were not married) Although my parents were not married, My mother was granted Administator of my father's estate on my behalf because I was under 18. Once I turned 18, my mother was no longer the Administrator and the power was now mine. By that time though, everything was settled. power of attorney questions? I have a step father who lives in Australia, ( I live in New Zealand). My mother passed away two and a half years ago and every thing was transfered into his name. After my mothers funeral my sister and I were asked by our Pop (step father) to take him to his lawyer to ogranise his will. She wants to make him power of attorney for her and he does not want the responsibility. What are the legal consequences of disobeying the requests of the person named as another person's Medical Power of Attorney, especially when the requests were in the patient's best interest? A nurse continued to administer medication after repeated requests by the patient's POA, to discontinue a drug that was causing the patient pain and suffering. A medication that was unnecessary for the patient's survival, and was ultimately causing the patient to be combative and irrational. The prescribing Dr was shocked, asking if the nurse had lost her mind. The Dr is obligated to get written permission from the POA before prescribing ANY medication for the patient, and cannot over ride the POA's decision to discontinue any and all meds at any time. No. This is NOT an end of life issue. It is Saturday night. Our attorney is unavailable until Monday. This will aggravate me till I can contact him or get some idea what our next step will be Thank you Thank you for your answers. A few more details: The patient is in a nursing home with Alzheimer's, and is far beyond competent. She reacts badly to antipsychotics (makes her more psychotic and hard to handle). The prescribing Dr and our attorney said her son (holder of the POA) has the final word in everything and is above question from anyone. They both said the nurse has lost her mind. The owner of the care facility is very nervous. We aren't the only family with issues because of her God complex. If "mother" behaves badly enough, she will have to be moved to another facility. Hence the overdosing with meds to make her behave badly. This "professional" is a menace.

One day he loves me and wants my help, the next day he hates me. The following day I am his best friend, the next day he wants to kill me. And so on. During those "bad" days he will tell the nursing home, "don't give my son any information about my health". And the nursing home listens to him! I will call there and ask the nurse "how is my father doing on the new medication" and they will say "your father says he doesn't want you to know his medical business". But the next day I can call and if he is in an OK mood, I can get the information. The POA states, "I wish my son (name here) to be treated as I would be treated with regards to my health care information". Isn't the nursing home making a mistake? This is in New York State. My mother passed away in June of last year. My Grandmother (Her Mom) passed away in April of this year. A few weeks before my grandmothers death, My uncle who had power of attorney over her estate changed beneficiaries on her IRA account to himself and my father. This eleminated my sister and I from getting what would have been my mother's share of the IRA since she passed away before my grandmother. We have just learned that my uncle has power of attorney of our step grandfather's estate. This was done two months ago. There is no blood relation. Our dad mentioned this to us after our Grandfather was found in a town several miles away without knowing where he was or how he got there. A medical review now shows he is incapacitated. He does have blood relatives living as well as grand children from a previous marraige. However; according to our dad his will does not include them. When asked about who does his estate go to, my dad said he did not know. It seems to me that if he knows who is excluded, he should know who is included. My sister and I feel like we are being left out of alot of the decision making since our mother passed away. We were left out when it came to my grandmothers estate, and it appears that it is happening again. So the questions are, Do we have any rights? Does it appear that our father and uncle are taking advantage of the situation? And shouldn't we have been informed of these decisions? What about his blood relatives, shouldn't they be consulted in this matter? This is a very substantial estate, and things seem a little shady. Should we confront my uncle in this matter? How to deal with Irresponsible Power of Attorney of the lanlord? I entered into my current apartment about 2 months back in Mumbai. I was supposed to enter into a rent aggrement through the power fo attorney (POA) of the lanlord. On the day of registration (I was already occupying the aprtment for a period of 7 days by that time... I had also given the POA the rent deposit as well as PDCs of rent for coming months), it was realised that his power of attorney was not valid for rental purposes.
